Chiera Sagl (hereinafter referred to as the “Company”) is a Swiss company with its registered office at Via Pioda 6, 6900 Lugano, CHE-493.793.488, and is the owner of this website www.agricolachiera.ch. All products sold on this online shop originate from Italy and have been previously imported into Switzerland by the Company itself.

All shipments to customers are made directly from warehouses located in Switzerland.

1. General

The Company reserves the right to modify these Terms and Conditions at any time. The version of these Terms and Conditions in force at the time of the order shall apply and cannot be unilaterally modified for ongoing orders. Any customer terms that conflict with or differ from these Terms and Conditions will not be recognized. The Company also reserves the right to change the prices of the products and services offered at any time. The price indicated in the online shop at the time of the order is decisive for the conclusion of the purchase contract. Deliveries are made exclusively to addresses located in Switzerland.

2. Availability and delivery time

The Company places great importance on keeping product availability and delivery times in the online shop constantly up to date. However, delivery delays may occur that are not attributable to the Company’s proper operations.

3. Non-payment

In case of full or partial non-payment by the customer to the company, the company may suspend further deliveries of products to the customer.

4. Copyrights

Copyright and all other rights to content, images, photos or other files on the website belong exclusively to the company.

5. Data Protection.

The Company complies with the provisions of Art. 13 of the Swiss Federal Constitution and the federal data protection regulations (Federal Act on Data Protection, FADP), as well as the Data Protection Ordinance (DPO), which establish that every individual has the right to the protection of their privacy and to protection against the misuse of their personal data. Personal data is treated with the utmost confidentiality and is neither sold nor disclosed to third parties. In close cooperation with our hosting providers, located in Switzerland, we strive to protect our databases as effectively as possible against unauthorized access, loss, misuse, or falsification. When you access our website, the following data is stored in log files: IP address, date, time, browser request, and general information transmitted about the operating system or browser. This usage data forms the basis for anonymous statistical evaluations, which allow us to identify trends useful for improving our offering. The data you provide when placing an order or making an inquiry will not be shared with third parties, but will be used exclusively internally, primarily to continuously improve our products and services. 6. Breakage/Damage

We take the utmost care in properly packaging our products. The final price does not include any risk coverage for returns due to external or hidden breakages. Therefore, we cannot be held responsible for such damages. Please carefully inspect the package upon delivery and refuse it if it is wet or visibly damaged.

7. Right of withdrawal

Although in Switzerland no legal claim can be made for the replacement or return of products purchased online, the Company grants a period of 14 days from the date of receipt of the goods to exercise the right of withdrawal, as specified below:

In both cases, a simple declaration of your decision to cancel the order is sufficient. To meet the withdrawal deadline, it is sufficient to send the communication concerning the exercise of the right of withdrawal before the expiry of the 14-day period from the date of receipt of the purchased products.

In any case, the purchased products must be returned at your own expense, all items intact (unopened) and in their original packaging, within 10 days from the withdrawal notice; otherwise, the right of withdrawal will lapse. Returns must be sent to the Company’s address: Chiera Sagl, Via Pioda 6, 6900 Lugano.
This right of withdrawal does not apply to transactions concluded with other businesses (B2B).

8. Consequences of revocation

In the event of order cancellation, the customer will be refunded promptly and no later than 30 days from the date of receipt of the returned products. Packaging and shipping costs are excluded. For this refund, the same payment method used for the original transaction will be applied, unless otherwise expressly agreed; in no case will any fees be charged for the refund.
